Acceptance of Terms

By downloading, installing, or using SafePath ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Informational Purposes Only

SafePath is designed to provide general emergency preparedness information and hazard awareness. The App is NOT a substitute for calling 911, contacting emergency services, or following official evacuation orders and emergency directives. Always follow the guidance of local authorities, first responders, and official emergency management agencies in an emergency situation. Do not rely solely on SafePath for life-safety decisions. Practice Drill and Emergency Mode features are for training and preparedness purposes only; they do not connect to real emergency services or dispatch systems. Travel advisory overlays and conflict risk data displayed in the Global Risk Profile are for general awareness only and do not constitute travel advice.

The AI Health Guidance feature provides general informational content only and does not constitute medical advice, diagnosis, or treatment. This feature is not a substitute for professional medical advice from a qualified healthcare provider. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you read in SafePath. If you think you may have a medical emergency, call your doctor or 911 immediately.

Emergency Data Accuracy

SafePath aggregates hazard and emergency data from third-party sources including USGS, NOAA, EPA, FEMA, NASA FIRMS, and the US State Department. While we strive to present this data accurately, we cannot guarantee the completeness, accuracy, reliability, or timeliness of information provided by these external sources. Data may be delayed, incomplete, or contain errors. You should always verify critical emergency information through official channels. Travel advisory and conflict risk data is informational only, intended for general awareness, and should not be the sole basis for travel decisions. Users should consult official State Department travel advisories directly at travel.state.gov and their own government’s travel guidance before traveling.

Subscriptions and Billing

SafePath offers optional paid subscriptions ("SafePath Plus") that provide additional features. Subscription details:

—Payment is charged to your Apple ID account at confirmation of purchase.
—Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
—Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
—You can manage and cancel subscriptions in your Apple ID account settings or through the App Store.
—Any unused portion of a free trial period is forfeited when you purchase a subscription.
—Refunds are handled by Apple in accordance with their App Store refund policies.

Acceptable Use

You agree to use SafePath only for its intended purpose of personal emergency preparedness and hazard awareness. You agree not to:

—Use the App to create false emergency alerts or spread misinformation.
—Attempt to reverse-engineer, decompile, or disassemble the App.
—Use the App in any way that violates applicable laws or regulations.
—Interfere with or disrupt the App’s third-party API integrations.

Intellectual Property

SafePath and its original content, features, and functionality are owned by SafePath and are protected by copyright, trademark, and other intellectual property laws. Hazard data sourced from government agencies (USGS, NOAA, EPA, FEMA, NASA, US State Department) remains the property of those respective agencies.

Limitation of Liability

To the maximum extent permitted by applicable law, SafePath and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

—Your use of or inability to use the App.
—Any actions taken or not taken based on information provided by the App.
—Unauthorized access to or alteration of your data.
—Any interruption or cessation of the App’s services or API integrations.

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that hazard data will be accurate or complete.

Termination

We reserve the right to suspend or terminate your access to SafePath at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date and make the revised Terms available within the App. Your continued use of SafePath after changes take effect constitutes acceptance of the revised Terms.

Indemnification

You agree to indemnify, defend, and hold harmless SafePath and its affiliates from any claim, damages, or expenses (including attorneys’ fees) arising from your use of the App or reliance on its data, violation of these Terms, or your communication of inaccurate or harmful information.

Governing Law and Dispute Resolution

GOVERNING LAW — These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.

—MANDATORY BINDING ARBITRATION — PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. You and SafePath agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
—The arbitration shall be administered by JAMS in accordance with its Comprehensive Arbitration Rules and Procedures, conducted by a single arbitrator in Contra Costa County, California, unless mutually agreed otherwise.
—CLASS ACTION WAIVER — YOU AND SAFEPATH AGREE THAT EACH PARTY MAY BRING DISPUTES ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
—WAIVER OF JURY TRIAL — YOU AND SAFEPATH HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.
—OPT-OUT PROCEDURE — You may opt out of this arbitration agreement by sending written notice to tktajik@gmail.com within thirty (30) days of first accepting these Terms.

This arbitration agreement shall survive the termination of your relationship with SafePath and the deletion of your account.
