Terms of Service
These Terms of Service govern your use of ScenicShift, an iOS application developed and operated by Tehmina Tajik. By downloading, installing, or using the app you agree to these terms. If you do not agree, please do not use the app.
Licence to use the app
You are granted a personal, non-exclusive, non-transferable, revocable licence to use ScenicShift on devices you own or control, for personal, non-commercial purposes. You may not copy, reverse-engineer, resell, or redistribute the app or any part of it.
What the app is — and is not
ScenicShift suggests routes for enjoyment, not for compliance. Road conditions, closures, surface quality, and posted limits change without notice. You are responsible for driving lawfully, within the limits of the road, your vehicle, and your ability.
Acceptable use
Do not use ScenicShift for any unlawful purpose, attempt to disrupt or overload its services, scrape or bulk-extract its data, or interfere with anyone else’s use of it. Accounts or devices engaged in abuse may lose access without notice.
Purchases and subscriptions
Any paid features are sold through the Apple App Store and are subject to Apple’s terms. Subscriptions renew automatically unless cancelled at least 24 hours before the period ends, and are managed in your Apple ID settings. Refunds are handled by Apple, not by us.
Third-party data and services
The app relies on third-party data providers and services. We do not control their accuracy, availability, or continuity, and their content remains the property of its owners. Interruption or discontinuation of a third-party source may change or remove app functionality.
Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. You use it at your own risk.
Limitation of liability
To the maximum extent permitted by law, Tehmina Tajik is not liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of, or reliance on, the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the preceding twelve months.
Termination
You may stop using the app at any time by deleting it. We may suspend or terminate access if these terms are breached, or discontinue the app entirely, with notice where reasonably possible.
Changes to these terms
These terms may be updated as the app changes. Material changes will be reflected in the effective date above and, where significant, surfaced in the app. Continued use after an update means you accept the revised terms.
Governing law and contact
These terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law rules. Questions can be sent to tktajik@gmail.com.
